Reserve your Fizz Rizz VIP membership

1. Conditional Membership

The Member is reserving one Fizz Rizz VIP membership in the proposed Fizz Rizz VIP Lounge, downstairs at Fizz Rizz in Rexburg, Idaho.

Signing this agreement does not activate the membership immediately.

No membership fee is due today.

2. Age Requirement

The Fizz Rizz VIP Lounge is an 18+ space.

Anyone entering the VIP Lounge must be at least 18 years old.

The Member represents that they are at least 18 years old.

Fizz Rizz may request reasonable proof of age before allowing access.

The 18+ requirement is a Fizz Rizz membership and access policy and is not based on alcohol service.

3. Launch Condition

Membership becomes eligible for activation only if Fizz Rizz officially opens the VIP Lounge to members on or before January 31, 2027.

Fizz Rizz is not obligated to launch the lounge simply because a person signs this agreement.

4. No-Launch Expiration

If the lounge has not launched by January 31, 2027:

• the conditional membership expires;
• recurring billing will never begin;
• the Member owes $0.

5. Activation Notice

If the lounge launches, Fizz Rizz will send the Member at least 7 calendar days' notice before the first charge.

The notice will identify:

• the membership activation date;
• the exact first billing date;
• the Member's monthly price;
• the cancellation method.

A Member who cancels before the first billing date will not be charged.

6. Membership Price

Upon activation, the membership costs the Member's recorded membership rate, shown at the top of this agreement:

• Founding 50 members: $20 per month (see Section 7).
• Members outside the Founding 50 will initially pay $25 per month upon activation.

The membership renews automatically each month until canceled.

Fizz Rizz will not change a Member's monthly price without notifying the Member in advance, and the Member may cancel, with no cancellation fee, before a new price applies.

7. Founding 50 Rate

The first 50 qualifying customers to complete the Founding 50 signup and required authorization will receive a Founding 50 membership price of $20 per month upon activation. No more than 50 Founding 50 memberships will be offered.

The Founding 50 rate remains available to that Member only while the Member's membership remains continuously active.

If the Member cancels or otherwise terminates the membership and later rejoins, the Founding 50 rate will no longer apply. The Member will be subject to the membership price offered at the time of re-enrollment.

The Founding 50 rate is personal and nontransferable.

8. What Membership Includes

Membership presently includes, at no additional admission charge, access to:

• racing simulators;
• karaoke;
• the Fizz Rizz VIP Lounge during published VIP hours;
• a members-only drink menu.

Specifically:

• racing simulator access is subject to availability, time limits, turn rotation, posted rules, equipment availability, events, maintenance, and lounge capacity;
• karaoke availability may vary with operating hours, events, equipment availability, and normal house rules;
• the members-only drink menu gives access to drinks and menu items offered to members. Drinks and menu items are purchased separately at their listed prices, unless Fizz Rizz explicitly states otherwise for a particular promotion. Specific drinks and menu items may change;
• equipment may occasionally be unavailable because of maintenance or events;
• membership does not guarantee use of any specific amenity at any specific time, and never guarantees uninterrupted or exclusive use of a racing simulator, karaoke equipment, seat, table, or other individual amenity.

Fizz Rizz may add other member experiences later.

9. Payment Authorization

Payment information is handled securely by Square, Fizz Rizz's payment processor. Fizz Rizz does not directly store the Member's full card number or security code.

By completing the secure authorization step with Square, the Member separately authorizes Fizz Rizz, through Square, to keep a payment method on file and to charge it the Member's recorded monthly rate only as described in this agreement: after the lounge launches, after the Member has received at least 7 calendar days' notice, and starting no earlier than the first billing date stated in that notice.

If the lounge does not launch by January 31, 2027, or if the Member cancels before the first billing date, this authorization expires and no charge will be made.

10. Cancellation Before Activation

A Member may cancel before membership activation.

If the Member cancels before the first charge, they owe $0.

To cancel, use the cancellation page at /cancel on this website, or email feedback@fizzrizz.com. No phone call is required.

11. Cancellation After Activation

After activation, Members may cancel future recurring renewals at any time using the cancellation page at /cancel or by emailing feedback@fizzrizz.com. Future recurring billing then stops according to these terms.

There is no cancellation fee.

Canceling a Founding 50 membership permanently ends that Member's Founding 50 rate (Section 7).

12. Capacity

Membership does not guarantee immediate admission.

Entry may be limited due to:

• physical capacity;
• safety requirements;
• temporary closures;
• private events;
• maintenance;
• operating-hour changes;
• other reasonable operating restrictions.

If the lounge is full, Members may need to wait.

Fizz Rizz initially limits membership to 100 members to manage capacity. Fizz Rizz may change this limit later.

13. Hours, Amenities and Changes

Fizz Rizz may make reasonable operational changes to:

• operating hours;
• days of operation;
• furnishings;
• events;
• amenities and equipment;
• entertainment;
• activities;
• specific food and beverage items;
• other operational features.

These changes do not allow Fizz Rizz to remove the core membership benefits listed in Section 8 while continuing to charge Members as before. If Fizz Rizz intends to permanently remove, or materially reduce, a core membership benefit, Fizz Rizz will notify Members in advance, before the change takes effect, and Members may cancel with no cancellation fee before their next billing date.

14. Personal Membership

Membership is personal and nontransferable.

Members may not:

• lend membership access;
• sell access;
• share membership credentials;
• misrepresent another person as a Member.

15. Conduct

Fizz Rizz may suspend or terminate access for serious or repeated misconduct, including:

• violence;
• harassment;
• threats;
• theft;
• intentional property damage;
• repeated disruption;
• unauthorized membership sharing;
• attempts to bring under-18 individuals into the 18+ lounge;
• serious violations of posted house rules.

16. Electronic Transactions

The Member agrees to conduct the signup electronically and accepts electronic agreements, signatures, records, notices, billing communications, and cancellation confirmations.

17. Governing Law

This agreement is governed by applicable federal law and the laws of the State of Idaho.
